Terms of Business

Ken Lenihan & Associates Ltd. was incorporated on the 18th day of January 2019 and registered under the Original Certificate of Incorporation No 641732. The Company Registered Office at Chapeltown, Fenit, Tralee, Co Kerry is registered to undertake insurance mediation as a Public Loss Assessor under the European Communities (Insurance Mediation) Regulations, 2005. The Central Bank of Ireland holds registers of regulated firms which can be viewed on their website www.centralbank.ie.  Ken Lenihan & Associates Ltd is Regulated by the Central Bank of Ireland  Registration No. C191287.

Ken Lenihan & Associates Ltd is subject to and complies with the Consumer Protection Code, the Minimum Competency Code and the Fitness and Probity Standards. These Codes offer protection to consumers and can be found on the Central Bank of Ireland website www.centralbank.ie

We will avoid any conflict of interest when providing business services to our clients. We will advise you of this in writing before proceeding to provide any business service.

Ken Lenihan & Associates Ltd shall ensure that we:

 

  1. Act honestly and fairly in conduction our business activities in the best interest of our clients and the integrity of the market.

  2. Act with due skill care and diligence in the best interests of our clients.

  3. Have and employ effectively the resources that are necessary for the proper performance of our business activities.

  4. Make an adequate disclosure of relevant material information in our dealings with our clients.

  5. Comply with the letter & spirit of all regulatory requirements applicable to the conduct of our business activities so as to promote the best interests of our clients & the integrity of the market.

There is no charge for the initial consultation. However, should you proceed with the insurance claim, a fee rate will be agreed, prior to submission of claim details to Insurers. Please note assessors fees are not normally recoverable under your insurance policy.

We will ensure that our customers’ complaints are dealt with and resolved as quickly as possible. We will acknowledge your complaint within 5 working days and we will fully investigate it. On completion of our investigation, we will give you a written response to the outcome. If you are not satisfied with our handling of, or response to your complaint, you are entitled to refer the matter to the Financial Services Ombudsman Bureau at 3rd Floor Lincoln House, Lincoln Place, Dublin 2. Under the provisions of the Data Protection Act 1988 and 2003, Ken Lenihan & Associates Ltd will collect your personal details in order to process your claim to the highest standard of service to you.

 

We take great care with the information provided; taking steps to ensure it is only used for legitimate purposes and no sensitive data will be collected.

 

To fulfil these objectives, we may share information with other affiliated professionals such as your Insurance Broker/Agent, Solicitor, Engineer, Surveyor, Architect, Building Contractor or any other person appointed by you to represent your interests.

  1. You have the right at any time to request a copy of any personal data within the meaning of the Data Protection Act. Data is kept for period of 6 years after closure of the claim, per the provisions of the Central Bank’s Consumer Protection Code.

  2. As the Data Subject, you have the right to access your data and to ensure that the data we hold is accurate and that errors are corrected.

  3. You have the right to instruct us in relation to the portability of your data; to the restriction of processing of the data; and to object to the processing of the data.

  4. You have the right to complain to the Data Protection Commissioner in respect of any aspect of your data and our processing/retention thereof.

Ken Lenihan & Associates Ltd holds professional indemnity Insurance in accordance with the Central Bank of Irelands’ requirements.

Our terms of business shall be governed by and construed in all respects according to the laws of the Republic of Ireland. These Terms of Business are valid from October 2019 until further notice.
